CORNWALL – A registered nurse who was working in Ottawa has been sentenced to 10 months in jail for possession of what a judge called a “severely depraved” collection of child pornography.
Scott Ezard, 37, of Cornwall, was found guilty in December 2009 for storing some 150 child porn movies and numerous images on his home computer.
Ezard, who has no prior criminal record, has since been terminated from his position at the Ottawa General Hospital.
“The titles themselves depict the depravity,” said Judge Michel Charbonneau, who also sentenced the former nurse to three years' probation.
Leading up to his arrest, the court heard how Ezard’s wife kept tabs on his Internet use, logging activity when he left the house. She eventually reported her findings to the Cornwall Community Police Service.
“He has affected me in the worse way possible,” his wife said in a statement to the court.
She also expressed concern for the future of the victims depicted in the videos.
Assistant Crown attorney Juliana Martel described the scenes on the digital files as “sexual tortures” of prepubescent girls aged 4 to 13. The scenes, she said, often involved rape. “The pain suffered by the children in these videos doesn’t end today,” Martel said. “It goes on and on.”
Martel urged Charbonneau to view a sample disc from Ezard’s collection. It was assembled by a detective from city police. Martel said it would help gauge the degree of the sexual abuse.
Defence lawyer Bill Wade argued that neither he nor his client denied that the graphic content on the videos are an aggravating factor.
“The (written) breakdowns done by Det. (Jeff) Carroll are quite thorough,” Wade said. “To require the court to view (the video) is quite prejudicial.”
Charbonneau decided not to view the encrypted sample DVD.
Among other standard conditions for sex offenders, the court restricted Ezard’s Internet access to employment use only.
Wade had been seeking a three-month sentence, while the Crown had proposed a sentence of approximately 18 months.
